Article 1 – Purpose and scope
These Terms set out the rights and obligations of Pure and Lab and its customers in connection with the online sale of the products offered on shop.pureandlab.com. The website www.pureandlab.com presents the brand and its products; orders cannot be placed on it.
They apply to orders placed by consumers acting for private purposes. The terms applicable to an order are those in force when the order is placed.
Article 2 – Products
Pure and Lab sells cosmetic and skincare products intended to be used in accordance with the instructions on their packaging, label or product sheet. The essential characteristics of the products are presented in the shop with the greatest care.
Photographs and illustrations aim to present the products as faithfully as possible. Slight differences in colour or rendering may occur depending on the screen and do not, in themselves, constitute a lack of conformity. Pure and Lab may change its range and withdraw a product from sale at any time.
Article 3 – Prices
The applicable prices are those shown in the shop at the time of the order. They are displayed in euros, including all taxes. Delivery costs are shown separately before the order is finally confirmed.
Pure and Lab may change its prices at any time; any change has no effect on an order already confirmed. In the event of an obvious pricing error, in particular of technical origin, Pure and Lab will inform the customer as soon as possible.
Article 4 – Ordering
The customer selects the products and adds them to the cart. Before confirming the order, the customer can check its contents, quantities, total price and contact details, and correct any errors.
The order becomes final when the customer confirms it and pays. An order confirmation is then sent to the email address provided.
Pure and Lab may refuse or cancel an order, in particular in the event of suspected fraud, a payment incident, unavailability of the product or an obvious error.
Article 5 – Payment
The available payment methods are those offered at checkout. Payment is made through the secure payment solutions integrated into the shop. The order is only considered paid once the transaction has been confirmed by the payment provider.
Pure and Lab does not have access to the customer’s full bank details, which are processed directly by the payment provider.
Article 6 – Availability
Products are offered while stocks last. Should a product become unavailable after the order has been confirmed, Pure and Lab will inform the customer as soon as possible; the customer may then obtain a refund for the product concerned or, with their agreement, another solution.
Article 7 – Delivery
Pure and Lab delivers in Belgium and internationally, mainly through bpost. Destinations, terms, rates and estimated delivery times are communicated before the order is confirmed.
The times indicated are estimates unless expressly agreed otherwise. In the absence of an agreed time, delivery takes place no later than 30 days after the conclusion of the contract. In the event of a delay, the consumer’s statutory rights remain fully applicable.
The customer is responsible for the accuracy of the delivery address provided. Pure and Lab cannot be held liable for a delay or failure of delivery resulting from an incorrect or incomplete address. Details are set out in the Delivery and returns policy.
Article 8 – Receipt of the order
On receipt, the customer is invited to check the condition of the parcel and the products. If a product is damaged, incorrect or missing, the customer should contact Pure and Lab as soon as possible at info@pureandlab.com, stating the order number and, if possible, attaching photographs. This does not limit the customer’s statutory rights in any way.
Article 9 – Right of withdrawal
In accordance with the Belgian Code of Economic Law, the consumer has 14 calendar days to withdraw from the contract without giving any reason. This period runs from the day on which the consumer, or a third party designated by the consumer, takes physical possession of the goods.
To exercise this right, the consumer must inform Pure and Lab of their decision by a clear statement, by email to info@pureandlab.com or by post to the seller’s address. The consumer may use the model withdrawal form in the annex, but is not obliged to.
Article 10 – Returning products after withdrawal
The consumer must send the products back without undue delay and no later than 14 days after communicating their decision to withdraw, to: ’t Hof te Overbeke 23, 1082 Berchem-Sainte-Agathe, Belgium.
Unless Pure and Lab indicates otherwise, the direct cost of returning the goods is borne by the consumer. The consumer is liable for any diminished value of a product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning. Products must be properly protected for return.
Article 11 – Sealed products and hygiene
The right of withdrawal does not apply to sealed goods which are not suitable for return for health protection or hygiene reasons and which have been unsealed by the consumer after delivery. This exception only concerns products whose sealed packaging or closure has actually been opened; it is not a general exclusion of all cosmetic products.
Article 12 – Refunds
Following a valid withdrawal, Pure and Lab refunds all payments received, including standard delivery costs, no later than 14 days after being informed of the decision to withdraw. The refund is made using the same means of payment as for the order, unless the consumer expressly agrees otherwise, at no cost to the consumer.
Additional costs resulting from choosing a delivery method more expensive than the standard delivery offered are not refunded. Pure and Lab may withhold the refund until it has received the products back or until the consumer has supplied evidence of having sent them back, whichever is earlier.
Article 13 – Legal guarantee of conformity
The consumer benefits from the legal guarantee of conformity provided by the Belgian Civil Code. For new goods, it covers any lack of conformity that becomes apparent within two years of delivery.
In the event of a lack of conformity, the customer should contact Pure and Lab at info@pureandlab.com. These Terms do not limit or exclude any mandatory right of the consumer.
Article 14 – Use of the products
The customer undertakes to use the products in accordance with their intended purpose, instructions for use, precautions and warnings shown on the product, its packaging or its documentation. If in doubt, the customer is invited to contact Pure and Lab before use.
Information about cosmetic products does not replace a diagnosis, treatment or medical advice where such advice is needed.
Article 15 – Liability
Pure and Lab cannot be held liable for damage resulting from misuse of a product, failure to follow the precautions for use or use clearly contrary to its intended purpose. No provision of these Terms excludes or limits any liability that cannot legally be excluded or limited.
Article 16 – Intellectual property
The content of the website and the shop — texts, photographs, illustrations, graphic elements, logos, names and presentations — belongs to their respective owners. Except with prior authorisation or where the law provides otherwise, its reproduction, distribution, modification or commercial use is prohibited.
Article 17 – Personal data
Personal data provided when using the shop and placing orders is processed in accordance with the Privacy policy and the General Data Protection Regulation (GDPR).
Article 18 – Force majeure
Pure and Lab cannot be held liable for any delay or failure to perform resulting from force majeure within the meaning of the applicable law.
Article 19 – Complaints
Any question or complaint about an order can be sent to info@pureandlab.com, by phone on +32 475 84 20 30 or by post to the seller’s address. Pure and Lab always seeks an amicable solution first.
Article 20 – Consumer dispute mediation
If no amicable solution is found, the consumer may contact, free of charge, the:
Consumer Mediation ServiceNorth Gate II, Boulevard du Roi Albert II 8, box 11000 Brussels, BelgiumPhone: +32 2 702 52 20Email: contact@mediationconsommateur.bewww.consumerombudsman.be
Article 21 – Governing law and jurisdiction
These Terms are governed by Belgian law, without prejudice to the more protective mandatory provisions of the consumer’s country of residence. In the absence of an amicable settlement, the competent courts are determined in accordance with the applicable legal rules.
Article 22 – Severability
Should any provision of these Terms be declared void or unenforceable, the other provisions shall remain applicable to the fullest extent permitted by law.
Article 23 – Changes to the Terms
Pure and Lab may amend these Terms, in particular to adapt them to changes in its business or in regulations. The version applicable to an order is the one in force when the order is concluded.
